Riding helmets are located in the tack room and available at no charge. You are welcome and encouraged to borrow a helmet for yourself. Parents are strongly encouraged to fit their children with helmets.
Photographic Release: I grant Sundance Trail Ranch the right to use my name and image in any materials that may be used for advertising and promotion of the ranch. My name and image may be used in all forms and media including composite or modified representations. I waive the right to inspect or approve versions of my image used for publication or the music, graphics and written copy that may be used in connection with these images. I release the ranch, its assigns, licensees and successors from any claims that may arise regarding the use of my image including any claims of defamation, invasion of privacy, or infringement of moral rights, rights of publicity or copyright. The ranch is permitted, although not obligated, to include my name as a credit with any image.
Visitor’s Assumption of Risk & Waiver of Liability - READ THIS DOCUMENT CAREFULLY BEFORE SIGNING. THIS DOCUMENT HAS LEGAL CONSEQUENCES AND WILL AFFECT YOUR LEGAL RIGHTS AND MAY ELIMINATE YOUR ABILITY TO BRING FUTURE LEGAL ACTIONS. <P> In consideration of the services of Morin & Morin Inc., Sundance Trail Properties LLC, Sundance Trail Guest Ranch, Aspen Grove at Sundance Trail, their owners, officers, directors, volunteers, contractors, employees, stockholders, agents, and all other persons or entities associated with those businesses (collectively referred to as “Sundance Trail Guest Ranch”), I agree as follows: <P> Although SUNDANCE TRAIL GUEST RANCH has taken reasonable steps to provide you with appropriate equipment and skilled guides so you can enjoy activities for which you may not be skilled, we remind you that these activities are not without risk. Certain risks cannot be eliminated without destroying the unique character of these activities. The same elements that contribute to the unique character of these activities can be causes of loss or accidental injury, illness, or in extreme cases, permanent trauma or death. We do not want to frighten you or reduce your enthusiasm for these activities, but we do think it is important for you to know in advance what to expect and to be informed of the inherent risks. The following describes some, but not all, of those risks of living on a ranch: injury, illness, trauma, or death. <P> I am aware that horse activities, bicycle riding, rock climbing or “bouldering,” shooting, “challenge obstacles,” hiking, and fishing entail risks of injury or death. Ranch life also involves interaction with a variety of animals, who may buck, rear, spin, roll, kick, step on, bite or otherwise injure others. I understand the description of these risks is not complete and that other unknown or unanticipated risks such as unexpected equipment failure, may result in injury or death. I understand that these hazards may be magnified due to altitude., weather and terrain. I agree to assume responsibility for the risks identified herein and those risks not specifically identified. This applies both to claims arising from the inherent risks of ranch activities and environment or the ordinary negligence of Sundance Trail Guest Ranch. My participation in these activities is purely voluntary; no one is forcing me to participate in spite of the risks. <P> I expressly acknowledge that naturally occurring disease processes (including, but not limited to the currently widespread Corona Virus) occur in all environments in which this activity will take place. I acknowledge that while the ranch has taken reasonable measures to avoid contact, transmittal, or contamination of the virus between people (including guests/participants, employees and other third parties) that it is ultimately my responsibility to safeguard myself and others. I understand and agree that, if I choose to participate in any activity that the ranch cannot and will not have any legal liabilities toward me if I contract the virus. On the other hand, if it is determined that I acted negligently or unreasonably and was responsible for transmittal of any disease) to other participants/employees, that I may be held legally and financially responsible for that transmittal. <P> Helmets for horseback riding, bicycle riding, rock climbing or any other activity, are located in the tack room and available at no charge. You are welcome and encouraged to borrow a helmet for yourself. Parents are strongly encouraged to fit their children with helmets. <P> I certify that I am fully capable of participating in these activities. I assume full responsibility for myself, including my minor children, for bodily injury, death, and loss of personal property and expenses thereof as a result of those inherent risks and dangers and of my negligence in participating in these activities. <P> I have read, understood and accepted the terms and conditions stated herein and acknowledge that this agreement shall be effective and binding upon myself, my heirs, assigns, personal representatives and estate for all members of my family, including any minors accompanying me. <P> WARNING: Under Colorado Law, an equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities, pursuant to section 13-21-119, Colorado Revised Statutes.*
